Automate batch errors when adding watermark (CS6)

i'm trying add watermark approx. 8,000 images batching process. however, 400. 2 errors logged are:

could not complete request because of program error. (-1)

could not complete command because selected area empty. (-25570)

any ideas?

 

edit: seems stop @ 'fill' part of action way..

looking @ screen capture of portion of action see make new empty layer , move named layer "layer 0". looks photoshop generated layer name layer created action or action expect layer exist. can not count on photoshop generating same name every time action runs.  if batching action on layered image files tiff, psd, psb "layer 0" may exist when action runs photoshop may generate name "layer 1" instead of layer or convert background layer post entire action , layers palette hard guess going on seeing part of , action , have no intel of current document????

 

when recording action better select layer in relative manor rather name.
