Can we use MP3 as a Fileformat for ingame Music on our commercial AIR game?

i read license part,

5.4 mp3 codec use. may not modify runtime libraries or build tools. may not access mp3 codecs within runtime libraries other through published runtime apis. development, use or distribution of developer application operates on non-pc devices , decodes mp3 data not contained within swf, flv or other file format contains more mp3 data may require 1 or more third-party license(s).

but wanted totally sure. mean can use mp3 file format our ingame music, sfx , speech files without having license? need official response matter quickly. little indie game dev studio, can't afford license fees (the mp3 frauenhofer institute license) have build workaround ...
